近日，上海市第一中级人民法院（以下简称上海一中院）审理了一起因航空公司拒载乘客引发的人格权纠纷上诉案件，二审最终判决驳回夏女士要求航空公司停止侵权、赔礼道歉等的诉请，维持原判。

登机前的一次冲突

导致乘客被拒载

2022年7月的一天。夏女士带着女儿赶赴上海浦东机场，准备飞往香港参加入学考试。可是在柜台办理值机手续时，夏女士因未找到入境材料，导致无法办理值机。于是夏女士向航空公司工作人员寻求帮助，经过工作人员的沟通建议，夏女士通过网络成功下载了本人的入境材料，可是其女儿的材料未能顺利下载。此时夏女士要求立即给她办理值机，但工作人员表示其女儿的材料未能下载，还不能办理。这时工作人员帮助夏女士联系香港方面，但在等待的过程中，夏女士与工作人员发生了口角甚至肢体冲突，工作人员报了警。在公安机关出警处置后，夏女士与工作人员口头和解。工作人员将此事汇报给了公司安全部门。后来，夏女士在自己的行李箱内发现她和女儿的入境材料，但此时已经超过了值机时间，她便改签了航班。
